1. Scope of application
The following General Terms and Conditions (GTC) apply to the use of this website and the business relationship between C. Hofer Handelsunternehmung and its customers in the version currently available and valid when the website is accessed or goods are ordered. The offer on this website is generally aimed at customers resident in Switzerland. A customer is defined as any natural or legal person who maintains business relations with C. Hofer Handelsunternehmung. The GTC, the terms of delivery and payment and the data protection provisions may be amended by C. Hofer Handelsunternehmung at any time. The most recent versions on the website are valid. These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation of C. Hofer Handelsunternehmung in order to be valid. Written confirmation also includes confirmation by e-mail. When using this website or ordering goods, the customer confirms that he accepts these GTC, including the terms of delivery and payment. Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
2. Information on this website
The website www.rizzy.ch and its subdomains contain information about products and services. Prices, product ranges and technical specifications are subject to change without notice. All information on www.rizzy.ch (product descriptions, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are to be understood as approximate values only and in particular do not constitute any assurance of properties or guarantees, unless explicitly stated otherwise. C. Hofer Handelsunternehmung makes every effort to ensure that all details and information on this website are correct, complete, up-to-date and clear, but no guarantee can be given either expressly or implicitly. All offers on this website are subject to change and are not to be understood as binding offers. C. Hofer Handelsunternehmung does not guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is subject to change at any time and without notice.
3. Prices
Prices are quoted net in Swiss francs (CHF).
Any deviations due to currency fluctuations or conversion fees during payment processing (e.g. by credit card providers or payment service providers) shall be borne by the customer.
Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process. Technical changes, errors and misprints excepted, in particular C. Hofer Handelsunternehmung reserves the right to change prices at any time without prior notice. Consulting and support services are not included in the sales prices.
Unless otherwise stated, the prices quoted by C. Hofer Handelsunternehmung for deliveries to Switzerland include statutory value-added tax if the products and services are subject to VAT.
4. Conclusion of contract
The offers on this website represent a non-binding invitation to the customer to order products and/or services from C. Hofer Handelsunternehmung. By placing an order via the website, including acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. C. Hofer Handelsunternehmung then sends an automatic order confirmation by e-mail, which confirms that the customer's offer has been received by C. Hofer Handelsunternehmung. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal. The contract is concluded as soon as C. Hofer Handelsunternehmung sends a declaration of acceptance by e-mail confirming receipt of the order for the products or services ordered. Orders will only be delivered once payment has been received in full (exception: delivery against invoice) and provided the goods are available. If it transpires after conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full, C. Hofer Handelsunternehmung is entitled to withdraw from the entire contract or from part of the contract. If the customer's payment has already been received by C. Hofer Handelsunternehmung, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay. C. Hofer Handelsunternehmung is not obliged to make a replacement delivery in the event of the contract being terminated.
5. Payment options and retention of title
The payment options specified in the order process via the online store are available to the customer. Large quantity orders may have different payment options. C. Hofer Handelsunternehmung reserves the right to exclude customers from individual payment options without giving reasons or to insist on payment in advance. C. Hofer Handelsunternehmung may charge interest on arrears of 5% per annum and a reminder fee of a maximum of CHF 50 per reminder if the customer defaults on payment. The products delivered to the customer remain the property of C. Hofer Handelsunternehmung until payment has been made in full.
6. Delivery, obligation to inspect, notification of defects and return
Delivery is made by post, courier service or personal delivery to the customer. For orders on account, the invoice will be sent by e-mail or by post. The benefit and risk shall pass to the customer upon dispatch or handover, insofar as this is legally permissible. If the delivery cannot be delivered or if the customer refuses to accept the delivery, C. Hofer Handelsunternehmung may terminate the contract after notifying the customer by e-mail and setting a reasonable deadline, and may charge the customer for the costs incurred. C. Hofer Handelsunternehmung endeavors to adhere to the stated delivery times. In the event of a delay in delivery, the customer is entitled to withdraw from the contract four weeks after the original delivery date. C. Hofer Handelsunternehmung must be informed of the withdrawal by post after expiry of the four weeks mentioned above and before receipt of the goods. In this case, the products already paid for will be refunded by C. Hofer Handelsunternehmung, less any handling costs. The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which C. Hofer Handelsunternehmung provides a warranty immediately, but no later than 7 days after receipt, in writing by letter to the registered office of C. Hofer Handelsunternehmung or by e-mail to admin@rizzy.ch. The notification must include photos of the damaged product, the order number and all other order details. Returns to C. Hofer Handelsunternehmung are made at the customer's expense and risk. The customer must return the goods in their original packaging, complete with all accessories, together with the delivery bill and a detailed description of the defects to the registered office of C. Hofer Handelsunternehmung. If the inspection by C. Hofer Handelsunternehmung reveals that the goods have no identifiable defects or that they are not covered by the manufacturer's warranty, C. Hofer Handelsunternehmung may charge the customer for the work involved, the return shipment or any disposal. 7. Exchange and right of withdrawal
No exchange and/or right of withdrawal can be granted to the customer, as the articles are created individually by a print-on-demand provider and the ordered goods usually go directly into production. 8. Warranty
C. Hofer Handelsunternehmung endeavors to deliver goods of impeccable quality. If defects are notified in good time, C. Hofer Handelsunternehmung guarantees that the item purchased by the customer is free of defects and functional for the statutory warranty period, which is generally two years from the date of delivery. It is at the discretion of C. Hofer Handelsunternehmung to provide the warranty through free repair, equivalent replacement or reimbursement of the purchase price. Further claims are excluded. The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances. The warranty for consumables and wearing parts is also excluded.
9. Liability
C. Hofer Handelsunternehmung excludes all liability, irrespective of its legal basis, as well as claims for damages against C. Hofer Handelsunternehmung and any auxiliary persons and vicarious agents. In particular, C. Hofer Handelsunternehmung is not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage or pure financial loss suffered by the client. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved. C. Hofer Handelsunternehmung uses any hyperlinks on the website solely to simplify the client's access to other offers. C. Hofer Handelsunternehmung cannot know the content of these websites in detail, nor can it accept any liability or other responsibility for the content of these websites.
10. Data protection
C. Hofer Handelsunternehmung may process and use the data collected during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data required for the fulfillment of services may also be passed on to contracted service partners or other third parties. For detailed information on data protection, please consult the C. 11. Further provisions
C. Hofer Handelsunternehmung expressly reserves the right to amend these GTC at any time and to bring them into force without prior notice. In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded. The place of jurisdiction is Bern, unless the law provides for mandatory places of jurisdiction.
